These Terms of Service ("Terms") govern your use of https://americanpurepoolsv2.netlify.app (the "Site") operated by American Pure Pool Service & Repair ("we," "us," or "our"). By using the Site, you agree to these Terms.
Pool cleaning, maintenance, repairs, and related work are performed under separate quotes, service agreements, or verbal arrangements we make with you directly. If those agreements conflict with these Terms, the service agreement controls for the work itself. Questions: justinpowell@att.net, (916) 806-6296, or (530) 878-2529.
1. About our business
We provide residential pool service in Placer County, California, including seasonal start-ups, weekly maintenance, cleaning, water testing and balancing, equipment repairs, and installations. We are licensed in California (CA License #980179).
Information on the Site (pricing descriptions, service lists, photos, and testimonials) is general in nature. Specific scope, schedule, and price for your pool are confirmed when you contact us and agree to service.
2. Using this website
You may use the Site for lawful purposes only. You may not attempt to disrupt the Site, scrape it in a way that impairs performance, probe our systems without permission, or use the contact form to send spam, threats, or unlawful content.
Content on the Site (text, graphics, logos, photos, layout) is owned by us or our licensors. You may not copy, reproduce, or republish Site content for commercial use without our written permission.
3. Contacting us and becoming a customer
Submitting the contact form or calling us does not create a binding contract for pool service. A customer relationship begins when we agree on services, pricing, and schedule with you, whether by phone, email, written estimate, or other communication.
You agree to provide accurate contact information and reasonable access to your pool and equipment areas so we can perform agreed work. Delays caused by locked gates, unsafe conditions, dogs, or failure to provide access may affect scheduling and are not our responsibility.
4. Quotes, pricing, and payment
This Site does not process payments. Fees for pool service are quoted based on your pool, location, and the work requested. Payment terms are explained when you sign up for service or approve a repair estimate.
We describe our approach as upfront pricing without binding long-term contracts on the Site. Any specific billing cycle, cancellation terms, or minimum visits will be communicated to you before service begins.
Repair and installation estimates are typically provided in writing when requested. Additional work beyond an approved estimate may require your approval before we proceed.
5. Pool service disclaimers
Pool conditions depend on weather, usage, equipment age, and factors outside our control. While we use professional practices and experience, we do not guarantee that any specific chemical reading, water clarity, or equipment outcome will persist for a particular time after a visit.
You are responsible for maintaining safe access, disclosing known hazards (electrical issues, structural problems, aggressive animals), and informing us of special instructions for your property. We may refuse or pause service if conditions are unsafe.
Advice on the Site or by phone is general. Equipment recommendations and upgrade suggestions should be confirmed on site. Follow manufacturer instructions for equipment you own.
6. Third-party links and reviews
The Site may link to third-party platforms such as Facebook, Yelp, or Google. We do not control those platforms and are not responsible for their content, policies, or outages. Reviews displayed on the Site or linked platforms reflect customer opinions at the time posted.
7. Disclaimer of warranties (website)
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by law, American Pure Pool Service & Repair and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including loss of profits, data, or goodwill.
Our total liability for any claim arising from your use of the Site (not from on-site pool work covered by a separate agreement) will not exceed one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be limited under California law, including certain consumer rights. Claims related to actual pool service performed at your property may be governed by separate agreements and applicable law.
9. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights, except to the extent caused by our gross negligence or willful misconduct.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute relating to these Terms or use of the Site will be brought in the state or federal courts located in California, unless otherwise required by law.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Continued use of the Site after changes constitutes acceptance of the updated Terms.
